fa تحلیل نهادی مهاجرت اجباری :مطالعه تطبیقی ظرفیت های حقوقی ج. ا.ایران و بحران نهادی غزه تخصصي Special پژوهشي Research &nbsp;<span dir="RTL" lang="AR-SA" style="font-size:14.0pt"><span style="line-height:107%"><span b="" nazanin="" style="font-family:">مهاجرت اجباری به‌مثابه پدیده‌ای پیچیده در چارچوب حکمرانی جهانی، مستلزم بازتعریف ظرفیت‌های نهادی در سطوح ملی و بین‌المللی است. این پژوهش با اتخاذ رهیافتی تطبیقی، کارآمدی مکانیسم‌های حقوقی جمهوری اسلامی ایران در حمایت از مهاجران اجباری را در تقابل با الزامات حقوق بین‌الملل واکاوی نموده و با تمرکز بر مطالعه موردی نوار غزه، خلأهای ساختاری ناشی از فقدان نهادهای حاکمیتی مستقل را تحلیل می‌کند. یافته‌ها حاکی از آن است که علیرغم تلاش‌های تقنینی ایران در زمینه پناهندگان، ناکارآمدی نهادهای نظارتی منطقه‌ای در غزه، چالش‌های حاد حقوقی ایجاد نموده است. مقاله با ارائه راهکارهایی در جهت تقنین هم‌سو با توسعه نهادی، بهبود چارچوب‌های حمایتی را پیشنهاد می‌دهد.</span></span></span> <p>The phenomenon of forced migration, as a complex issue within the framework of global governance, necessitates a redefinition of institutional capacities at both the national and international levels.<br> Adopting a comparative approach, this study examines the effectiveness of the legal mechanisms of the Islamic Republic of Iran in protecting forced migrants in contrast with the requirements of international law, and&mdash;focusing on a case study of the Gaza Strip&mdash;analyzes the structural gaps arising from the absence of independent governing institutions.<br> The findings indicate that, despite Iran&rsquo;s legislative efforts regarding refugees, the inefficiency of regional oversight bodies in Gaza has created severe legal challenges.
